Introduction and Key Definitions

Welcome to She-Fancy (referred to herein as the “Website” or the “Platform”). These Terms and Conditions (“Terms”) constitute a legally binding agreement between you, as a visitor, user, and/or purchaser (“you”, “user”), and She-Fancy Trading (“Website”, “we”, “us”, “She-Fancy”), an online platform specialized in the sale of beauty products, skincare, hair care, nail care, accessories, and related items.

By accessing or using the Website, whether as a visitor and/or a registered user and/or by purchasing any product, you acknowledge, accept, and agree to be bound by these Terms, and further confirm that you have read, understood, and agreed to our Privacy Policy, Return and Refund Policy, and all other policies published on the Website.

2. Definitions

The following words, wherever they appear in these Terms and Conditions, shall have the meanings assigned to them below, unless the context indicates otherwise:

Website / Platform / She-Fancy: The She-Fancy online website, including all its pages, applications, and services associated therewith.
User / You: Any person who visits the Platform and/or uses its services and/or creates an account and/or makes a purchase.
Products: The goods offered for sale on the Platform, including but not limited to beauty products, cosmetics, personal care, skincare, hair and nail care products, and accessories.
Third Party / Supplier: Any external entity responsible for shipping products directly to users (within the dropshipping system).
Payment Channels / Payment Methods: The electronic and financial methods made available by the Platform for completing purchases, including — without limitation — credit and debit cards, digital wallets, bank transfers, cash-on-delivery (where applicable), and any additional payment methods that may be introduced by the Platform in the future.

3. User Eligibility and Accounts

Legal Eligibility: As a User, you must be at least 18 years of age and possess full legal capacity to enter into contracts under the laws of the Hashemite Kingdom of Jordan or the applicable law in your country of residence.
Account Registration: You, as the User, are fully responsible for maintaining the confidentiality of your account information, including your username and password, and are responsible for all activities conducted using your account. You must also provide us with accurate, complete, and up-to-date information when registering the account, making a purchase, or in the event of any modification to your information, and refrain from impersonating any other individual or entity.
Account Termination: She-Fancy reserves the right, at its sole discretion and without prior notice, to suspend, terminate, or restrict your access to the Website in case of violation of these Terms and/or any applicable laws.

4. Products, Orders, and Pricing

Product Availability: All orders are subject to the availability of stock, either with us or with the Third Party. If we are unable to provide any product you have ordered, we will notify you and refund the full amount you have paid.
Accuracy of Descriptions: We make every effort to display products as accurately as possible. However, we do not guarantee that product descriptions, colors, or images are error-free, and actual colors may vary depending on your device settings and/or product photography.
Price Changes: Prices are subject to change at any time without prior notice. Note that a price change will not affect orders that have already been confirmed.
Currency and Taxes: All prices are displayed in the currency shown at checkout. and you, as the User, are responsible for paying any taxes, customs duties, or additional charges imposed by your destination country, which are not our responsibility but are your responsibility as the User. For international orders, the user assumes full responsibility for customs duties, taxes, and clearance fees. She-Fancy shall not be liable for any delay caused by customs procedures.

5. Shipping & Delivery (Including Drop Shipping)

Shipping Responsibility: Shipping and delivery times are estimated and not guaranteed. She-Fancy shall not be liable for any delay, loss, or damage that occurs during the shipping process after the product has been handed over to the shipping company.
Transfer of Risk: The risk of loss or damage passes to you as the user once the order is handed to the shipping company.
Drop Shipping:
- You, the User, acknowledge and agree that some Products may be shipped directly to you from trusted external suppliers working with She-Fancy.
- Drop Shipping Disclaimer:
  Although we carefully select our suppliers, we, as the Website, are not directly responsible for any unexpected delays or minor differences in packaging or external labels that may appear on the shipment. She-Fancy remains the primary point of contact for all inquiries related to the order and product quality.

6. Shipping Restrictions

The Website does not currently ship to P.O. Boxes or APO/FPO addresses for certain drop-shipped items due to carrier limitations. If shipping to your address is not possible, you will be notified and a full refund will be arranged.
Some cosmetic product ingredients may be restricted or prohibited in certain countries. It is the user's responsibility to ensure products comply with local import regulations.

7. Returns & Refunds

All returns and refunds are subject to the terms of the specific Return and Refund Policy published on the Website, which the User acknowledges having reviewed, and which is considered an integral part of these Terms.

Non-Returnable Products: Cosmetic products, beauty preparations, personal care items, or any other products clearly specified as non-returnable, or once opened or used, cannot be returned or exchanged for reasons related to health, hygiene, and safety.
Condition of Returned Products: Returned items must be unused, unopened, in original condition, and accompanied by original packaging, labels, and invoice.
Return Fees: A restocking fee may apply, or you may be responsible for the shipping costs related to the return, unless the return is due to an error on our part as the Website (such as receiving a wrong or damaged product).

8. Intellectual Property Rights

Ownership: All content on the Website, including but not limited to, texts, graphics, logos, icons, images, video clips, software, and their compilation, is the exclusive property of She-Fancy or licensed to it, and is protected by international copyright, trademark, and intellectual property laws.
Limited License: The User is granted a limited, non-exclusive, and revocable license to access and use the Website for personal, non-commercial shopping purposes only. Copying, reproducing, selling, reselling, or exploiting any part of the Website for any commercial purpose without the explicit prior written consent of She-Fancy is strictly prohibited.

9. Disclaimer & Limitation of Liability

Disclaimer: The Website, products, and services are provided “as-is” and “as available,” without any warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability: She-Fancy and/or any of its officers, directors, authorized signatories, employees, and/or agents shall in no event be liable for any direct, indirect, incidental, punitive, or consequential damages of any kind whatsoever (including loss of profits, loss of data, or business interruption) resulting from your use, the User, or inability to use the Website or purchase the Products, even if She-Fancy has been advised of the possibility of such damages
Indemnification: You, the User, agree to indemnify and hold harmless the She-Fancy Website from any claims, damages, liabilities, losses, or costs arising out of (a) your misuse of the Website or Products, (b) your breach of any term of these Terms, or (c) your violation of any law or third-party rights.
Maximum Liability: If it is proven that the She-Fancy Website is liable to you for any damage or loss you, the User, have incurred, She-Fancy's liability shall not exceed the amount you, the User, paid for the Product that led to the claim, or shall not exceed 500 Jordanian Dinars in all cases. Furthermore, if one year has passed since the User ordered the Product, the User shall not be entitled to make any claims against the She-Fancy Website.

10. Product Use

Products offered for sale through our website (including cosmetics, skincare, haircare, etc.) are intended for use by adults only. It is solely your responsibility, the User, to read all labels and instructions accompanying the Product before use.
She-Fancy is not liable for allergies, reactions, injuries, or damages arising from product use, including misuse or failure to follow instructions. If you, the User, suffer from any known and/or unknown allergies, you bear the responsibility of carefully checking the list of ingredients before purchase and use.

11. Governing Law & Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Hashemite Kingdom of Jordan.
Dispute Resolution:
- Amicable Settlement: The User and the Website agree to make good faith efforts to settle any dispute or claim arising out of or relating to these Terms through direct negotiations first.
- Arbitration & Jurisdiction: If no settlement is reached within (30) days, the User and the Website agree to refer the dispute to mandatory arbitration in Amman – Jordan, in accordance with the arbitration rules applicable in Jordan for disputes exceeding 10,000 Jordanian Dinars, and the arbitration decision shall be final and binding on both parties. If the value of the dispute is less than 10,000 Jordanian Dinars, the Jordanian courts shall have jurisdiction to hear the dispute.

12. Miscellaneous Provisions

Modifications: She-Fancy reserves the right to amend or update these Terms at any time. In the event of amendments, the updated version will be published on this page with a "Last Updated" date. Your continued use of the Website after the publication of the amendments constitutes your acceptance of the modified Terms.
Severability: If any provision of these Terms is deemed unlawful, void, or unenforceable, that provision shall be severed from the rest of the Terms, and the remaining provisions shall remain in full force and effect.
Entire Agreement: These Terms, along with the Privacy Policy and all published policies, constitute the entire agreement between you and She-Fancy regarding Website use.
